There are many situations a pet owner or anyone concerned with animal welfare may face.  Fortunately, in an era where pets are now  regarded as family members by most people, there are an abundance of organizations, agencies and websites that can help identified in the column on the left.   

Pets are regarded under the law as personal property that, without prior planning, will pass to your heirs just like your your couch or your car.  The column on the right allows you to review the many California statutes that affect dogs, cats and other domesticated and non-domesticated animals.   It will also discuss appellate cases or particular code provisions that relate to the damages you may recover if your pet is killed or injured.

California Appelltate Law Concerning Pets 

  • McMahon v. Craig (2009)  No right to emotional distress or loss of companionship damages by the devoted owner of her five-year old Maltese due to malpractice by her veterinarian.
  • Kimes v. Grosser (2011)  Veternerian and other reasonable costs incurred for the treatment of a pet injured by another can be recovered as can punitive damages if the act was willful.
  • Plotnik v. Meihaus (2012)  Damages for emotional distress are recovera under a trespass to chattels theory where the act injuring the pet was intentional. The case suggests damages would have been proper had the act been negligent.
